Q. What is cellYourBrand? A. cellYourBrand is a Mobile Marketing Program that provides a direct medium to allow Brands to communicate key marketing messages under the form of text message-based multiple choice questions to a specific audience. The program consists of multiple Brand-specific Mobile Marketing campaigns. Each campaign under the cellYourBrand Program is customized for the Sponsor Company or Brand and is different from the other campaigns by the keyword that you enter in order to opt in, the related text message content and the prizes available to campaign participants.
Q. Who can participate? A. Each Brand-specific cellYourBrand campaign is open to a defined user group, as identified by the Sponsor Company. You must be a member of the user group in order to participate. Users normally learn about the program through specific marketing materials and communications distributed by the Sponsor Brand. You can also participate if you are a member of the specified group and learn about the program by reference from another member. For example, a defined user group for a campaign may include the sales staff of a series of retail store chains or the field employees or contractors of the Sponsor Brand. The Sponsor Company has its own sales reps who visit retail stores that sell the Sponsor’s products on a regular basis. During such visits, the Sponsor Company’s sales reps conduct product training, merchandising and sales events in assigned to them stores. Part of their dialogue with retail store associates during the same store visits includes telling them about cellYourBrand and providing instructions how to opt in. Retail store associates opt in via text message from their mobile phones while still conversing with the Sponsor company’s sales reps.
Q. Is there a cost to me in order to participate? A. Please refer to your mobile phone account text messaging plan. Messaging and Data Rates May Apply.
Q. How do I sign up to participate? A. You need to text the specific campaign keyword (example: MVENTIX), an account name you are affiliated with (for example Wal-Mart) and a participant code or the store number (example: 123), separated by spaces to the program short code 29608. Q. What do I do after I opt in? A. You will start receiving campaign text messages (up to 5 per week) with multiple choice questions, surveys and information alerts on a regular basis. 1. Sponsors/Administrator: cellYourBrand (The “Program”) is a Mobile Marketing program providing a direct medium to allow Brands to communicate key marketing messages under the form of text message based multiple choice questions and alerts to a specific audience. The Program consists of multiple Brand-specific Mobile Marketing campaigns (The “Campaign” or “Campaigns”). Administrator: mVentix, Inc. 26893 Bouquet Cyn Rd Ste C337, Santa Clarita, CA 91350.
2. Eligibility: Sales associates that are US residents and are 18 years of age or older, and are contracted or employed full-time or part-time at any authorized Sponsor reseller or retailer in the United States are eligible to register and participate (The “User” or “Users”). Verification of employment is required by all prize winners. Users normally learn about the Campaign through marketing materials and communications distributed by the Sponsor, its retail representatives and agencies. You can also participate if you are a member of the specified User group and learn about the Campaign by reference from another User. Employees and immediate families of Administrator, Sponsor, their advertising and promotion agencies, and their subsidiaries and divisions, are not eligible to participate or win. By entering the Campaign and any related promotions, Users are bound by and agree to these Campaign-specific terms and conditions. Void where prohibited by law.
3. Program Period: The Campaign will begin on January 1, 2009 at 12:00 AM and end on December 31, 2010, 11:59:59 PM. Users may choose to opt out at any time by texting “STOP” to the Campaign short code 29608.
4. How to Register: If you have a text messaging capable phone, you may register for a Campaign by texting the specific Campaign keyword (example: MVENTIX), an account code (for example 22) and a participant code (example: 123), separated by spaces to the program short code 29608. 5. How to Participate in a Campaign: Subsequent to registration (as stated in # 4), up to 5 alerts, multiple choice quiz or survey questions per week will be sent to your phone via text messaging.
Quiz questions will include several possible answers, and each answer will be marked by a letter/number combination. To answer a quiz question, you must reply to the original text message with the letter/number combination of the answer that you think is correct. You must only include the answer letter/number in your text message reply. You will shortly receive an automatic text message response stating that your answer is correct or incorrect. Any text message replies to quiz questions that consist of characters in addition to the answer letter will be considered incorrect. Only the first one (1) answer per question per mobile phone number will be entered into a prize drawing if the answer is correct. The same answer also must be submitted within the qualifying prize period and by midnight, pacific time of the day the question was sent to you in order to qualify as a valid entry into the next drawing to win a prize. If you submit more than one answer to a question, your additional answers will not qualify for a prize drawing entry and you will receive an automatic text message reply to each of your answers, stating that you have already submitted an answer to the question.
Survey questions will include several possible answers, and each answer will be marked by a letter/number combination. To answer a survey question, you must reply to the original text message with the letter/number combination of the answer that you think is correct. You must only include the answer letter in your text message reply. You will shortly receive an automatic text message confirming that you survey answer has been received. Your first survey answer for each question will be entered into the next drawing to win a prize. The same answer also must be submitted within the qualifying prize period and by midnight, pacific time of the day the question was sent to you in order to qualify for a valid entry into the next drawing to win a Sponsor prize (qualifying periods, prize drawing frequency, number of winners per drawing and prize drawing dates are different for each Sponsor Campaign, see Sponsor Campaign specific terms and conditions for more details by clicking on the Sponsor link above). If you submit more than one answer to a question, your additional answers will not qualify for a prize drawing entry and you will receive an automatic text message reply to each of your answers, stating that you have already submitted an answer to the question.
Qualifying quiz and survey answer entries may be entered into the same pool for a random drawing to win a prize or into separate pools. In addition to the above entry rules, you must be an active Campaign participant at the time of prize drawing in order to qualify to win a prize. Entrants that submit entries by text messaging will be charged according to their rate plan for text messaging and for every question that you answer. 6. Periodic Prize Drawings: Prize drawings will be conducted weekly each Sunday between 10:00 AM and 12:00 PM from among all eligible entries submitted between Monday, 12:00 AM and Sunday, 10:00 AM of the same week. The Administrator, an independent judging organization whose decisions will be final and binding in all matters related to these prize drawings, will randomly select one (1) active Campaign User as a potential prize winner per week from amongst all eligible entries received for that week. Entrants selected must comply with all Campaign terms and conditions, and winning is contingent upon fulfilling all requirements. Potential winners who entered the contest via text message will be notified by text message, containing a unique prize code and instructions on how to claim the prize within 30 days of the receipt of the winner notification text message. Potential winners who entered the contest via the alternate method of entry will be notified by e-mail to the e-mail address they provided at the time of entry. The notification e-mail will contain a unique prize code and instructions on how to claim the prize within 30 days of the receipt of the winner notification e-mail. If a potential winner does not claim a prize as stated in the winner notification text message, the Administrator or the Sponsor may attempt to contact the potential winner via e-mail, or phone. If a potential winner cannot be contacted, prize is returned as undeliverable, or fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if required), potential winner forfeits prize. In the event that a potential winner is disqualified for any reason, Sponsor reserves the right to award the prize to an alternate winner or not to award the prize. Prizes will be fulfilled up to 10 weeks after a valid prize claim is submitted. Sweepstakes and prizes are non-transferable, non-refundable and no substitutions will be permitted. Sponsor reserves the right to substitute prize of equal or greater value in the event of prize unavailability. All federal, state and local taxes are the sole responsibility of winners.
7. General Rules:
a. By entering, entrants fully and unconditionally agree and accept to be bound by these Program rules and by any additional Campaign-specific riles and the decisions of Administrator, which shall be final. Administrator has the right to modify these rules and Sponsors have the right to modify any Campaign-specific rules in their sole discretion for clarification purposes at any time without materially affecting the terms and conditions of the Program and Campaigns.
b. Except where prohibited, acceptance of any prize constitutes winner's (or parent/legal guardian's) consent to Sponsor's use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
c. Entrants enter at their own risk. Administrator and Sponsor are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incorrect, incomplete, ineligible or unintelligible entries; (ii) telephone, electronic, hardware, software program, network, Internet or computer failures or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Administrator and/or Sponsor that may cause the Program to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, use or misuse of a prize, or from participation in the Program; or (vi) any printing or typographical error in any materials associated with these Official Rules or the Program generally and any associated Campaigns specifically. Entrants assume all liability for any injury or damages caused or claimed to be caused by their participation in the Program and/or the acceptance and/or use of any prize, and release Administrator and Sponsor, and their respective officers, directors, employees, parents, subsidiaries and affiliates from any and all such liability. Administrator, Sponsor, and their respective officers, directors, employees, parents, subsidiaries and affiliates assume no responsibility for any injury or damage to participants or to any other person's mobile device and/or computer relating to or resulting from entering or downloading materials or software in connection with this Program.
PLEASE NOTE THAT A HIGH VOLUME OF SMS (TEXT MESSAGING) ENTRIES OR TECHNICAL DIFFICULTIES WITH THE SYSTEM, MAY RESULT IN TEMPORARY INABILITY TO ENTER THE PROGRAM OR A DELAY IN THE PROCESSING OF ENTRIES SUCH THAT YOUR ENTRY IS NOT RECEIVED IN TIME TO PARTICIPATE. ADMINISTRATOR AND SPONSORS ARE NOT RESPONSIBLE OR LIABLE SHOULD ANY ENTRY NOT BE RECEIVED DUE TO SUCH DELAYS.
d. Administrator and/or Sponsors may prohibit any entrant or potential entrant from participating in the Program, if at the sole discretion of Administrator and/or Sponsor, such person shows a disregard for these Official Rules, any Campaign-specific rules, or acts (1) with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsor, Administrator or their agents or representatives; or (2) in any other disruptive manner.
e. In the event of a dispute as to the identity of an entrant entering via the method set forth, the authorized account holder of the cellular phone used to enter, if applicable, will be deemed to be the entrant. "Authorized account holder" of a cellular phone is the natural person in whose name the phone has been issued and to whom services are billed.
f. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, all Campaign-specific rules or the rights and obligations of the participant, the Administrator and the Sponsors in connection with the Program, shall be governed by and construed in accordance with the laws of the state of California without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of California. 8. Prizes: Weekly prizes will consist of consumer electronics products as follows: SAMSUNG 10.2-Megapixel Digital Camera (retail value $149.99), Plantronics Bluetooth Headset (retail value $99.99), EPSON Artisan 800 Wireless Multifunction Photo Printer/Copier/Scanner (retail value $299.99). 9. Winners' List: Winners lists for the Campaign will be published on the Campaign website www.mVentix.com/cellYourBrand and any other Campaign-related materials as determined by the Sponsor. 10. Personal Information: Information collected from entrants is subject to the mVentix, Inc. Privacy Policy and the privacy policy of each Campaign Sponsor.
11. Agreement to Official Rules: By accepting any prize, an entrant fully and unconditionally agrees to and accepts these Official Rules, the Campaign-specific Terms and Conditions, and the decisions of Sponsor and Administrator which are final and binding in all matters related to the Program.
